1. Definitions
1.1 “Company” means DJF Services Limited.
1.2 “Customer” means the person or organisation for whom the Company agrees to carry out works.
1.3 “Operative” means the representative, employee or sub-contractor appointed by the Company.
1.4 “Contract” means the agreement for the provision of services between the Company and the Customer.
2. Services & Scope
2.1 The Company provides property maintenance, refurbishment and related services (building, roofing, carpentry & joinery, electrics, plumbing, heating & gas, commercial heating, gas-safety / boiler services, external works and related services). Services listed on the Site describe typical provision but each Contract is as specified in the written estimate or quotation.
3. Rates, Call-Out Bands & VAT
3.1 Rates – The call-out and hourly rates applicable to any job are the rates published on the Company’s Website (/rates) at the time the booking is accepted by the Customer. Rates may be updated periodically, and all prices are stated exclusive of VAT.
3.2 Minimum charge & increments — unless otherwise agreed in writing, call-outs and hourly work are charged at a minimum of 1 hour, thereafter charged in 30-minute increments as per the standard market practice.
3.3 Changes to rates — The Company may update rates from time to time. The rate that applies to a job is the rate published on the Site at the time the job is booked/authorised, unless a different rate is stated in a written quote.
3.4 VAT — all sums payable to the Company are exclusive of Value Added Tax (VAT) which will be charged at the prevailing rate where applicable.
4. Estimates, Quotations and Fixed Price Work
4.1 Any written quotation is valid for 30 days from issue unless it says otherwise. Oral estimates are not binding.
4.2 For hourly rate work, the total charge will be materials (itemised) plus operative time charged in accordance with these hourly / call-out rates. For fixed price work, the written fixed price will state whether it includes labour, materials and VAT. Where a fixed price is given it will be a firm cost and will only vary in the circumstances described in clause 4.3.
4.3 The Company may vary a written estimate where:
(a) the Customer instructs additional works not covered by the original estimate;
(b) there is a significant unforeseen rise in materials costs; or
(c) where additional work is discovered that could not reasonably have been foreseen at the time of the estimate. Where possible, variations will be agreed in writing before work proceeds.
5. Materials, Parts & Title
5.1 Materials and parts supplied by the Company will be itemised on the invoice. The Company may charge for parts at cost plus a reasonable handling or markup charge (the Company’s material markup will be disclosed on request)
5.2 Title to goods supplied remains with the Company until paid for in full. Risk in such goods passes to the customer on delivery.
5.3 No Guarantee applies to materials supplied by the Customer.
6. Access, Permits & Safety
6.1 The Customer must provide safe and reasonable access to the premises and obtain any licences or consents (including landlord consents) required for the works. The Company accepts no liability for delays caused by the Customer failing to obtain necessary permissions.
6.2 The Company is not liable for delays caused by inability to access the site.
6.3 If asbestos or hazardous materials are discovered on site, the Company will follow applicable guidance and may suspend work pending safe removal and any required notifications. Any additional cost will be charged to the Customer.
7. Attendance, Cancellation & No-Shows
7.1 The Company will make reasonable efforts to attend at the agreed time but cannot guarantee attendance times due to travel, traffic, or emergency work.
7.2 If the Customer cancels a booked appointment with less than 24 hours’ notice, or fails to provide reasonable access, the Company reserves the right to charge the call-out fee and any reasonable costs incurred. (Industry practice varies; many contractors apply the first-hour charge or a cancellation fee).
8. Guarantees & Liability
8.1 Guarantee — the Company’s standard guarantee for workmanship is 12 months from completion, provided that payment has been made in full and provided the defect is reported within the guarantee period. Manufacturer’s guarantees on parts supplied will apply where stated.
8.1.1 The guarantee does not cover:
- misuse, accidental damage, or neglect;
- normal wear and tear;
- issues arising from pre-existing faults;
- materials supplied by the Customer.
8.2 Liability — the Company will perform services with reasonable skill and care. Nothing in these terms excludes or limits your statutory rights under the Consumer Rights Act 2015 where the Customer is a consumer.
8.2.1 The Company is not liable for:
- hidden defects not visible at inspection;
- structural issues or failures unrelated to work performed;
- consequential or indirect loss.
9. Payment Terms & Late Payment
9.1 Unless otherwise stated on a written quote/invoice, all balances for works become due on completion and are payable by bank transfer, card or other methods shown on the invoice.
9.2 If any invoice is not paid on the due date the Company may charge interest at 4% above the Bank of England base rate and recover reasonable debt collection costs.
10. Complaints, Defects & Remedies
10.1 If the Customer is not satisfied with completed works the Customer must notify the Company in writing within 7 days of completion for the Company to inspect and, if appropriate, undertake remedial work. Failure to notify in time may limit the Company’s liability.
11. Subcontractors & Third Parties
11.1 The Company may use contractors or subcontractors to carry out any part of the work. The Company remains responsible for work carried out by the subcontractor to the same extent as if it had done the work itself, subject to applicable warranties and limitations.
12. Data Protection & Privacy
12.1 The Company collects and processes personal data in the course of providing services. DJF Services Limited will process personal data in accordance with the UK GDPR and Data Protection Act 2018. The Company’s Privacy Policy (available on the Site) sets out the types of personal data processed, purpose, legal basis, data retention and data subject rights.
13. Health & Safety / CDM
13.1 Both parties will comply with the Construction (Design and Management) Regulations 2015 where applicable. If the works constitute a notifiable project under CDM 2015, the Client must notify the project and meet the client duties under CDM or appoint a principal designer/principal contractor as required by law.
14. Parking, Congestion & Additional Charges
14.1 The Customer is responsible for parking, access and, where applicable, congestion charges.
14.2 Any additional costs will be added to the final invoice.
15. Waste Disposal
15.1 Waste removal is not included unless expressly stated.
15.2 Disposal services can be provided at additional cost.
16. Force Majeure
16.1 The Company is not liable for delay or failure to perform due to circumstances beyond its reasonable control (e.g., strikes, extreme weather, supply chain failure).
17. Jurisdiction & Governing Law
17.1 These terms and any Contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.
18. Miscellaneous
18.1 Any variation of these terms must be in writing and signed by a duly authorised representative of the Company.
18.2 If any provision is found unenforceable the remainder shall remain in force.
18.3 The Company may take photographs or videos of the works before, during and after completion for documentation, compliance and quality assurance. Images may also be used for marketing purposes, including on the Company’s Website and social media pages, provided no individuals, personal items or identifiable information are shown. Customers may request that their property images are not used for marketing at any time.
